These Terms and Conditions (“Terms”) govern your use of and access to the products and services provided by SimplySim (“Company,” “we,” “us,” or “our”), including but not limited to the purchase and use of our eSIM cards, associated data plans, and website services (collectively, the “Services”). By purchasing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not purchase or use our Services.
1. Definitions
- “eSIM”: A digital SIM that allows you to activate a cellular plan from a carrier without using a physical SIM card.
- “You” / “User” / “Customer”: Any person or entity purchasing or using our Services.
- “Website”: Any official SimplySim website, including all related subdomains and online platforms operated by us.
- “Personal Use”: Private, non-commercial use by an individual.
eSIMs supplied under these Terms may not be resold, sublicensed, or otherwise distributed for
commercial gain.
2. Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase or use our Services.
- By placing an order, you confirm that you have the legal capacity to enter into a binding contract and that the information you provide is accurate, complete, and current.
3. Service Description
- Coverage: SimplySim provides eSIMs for use in multiple countries worldwide. Actual coverage depends on local network operators and may vary by location.
- Data Plans: We offer various data plans (including unlimited, limited, and pay-as-you-go options) that allow you to access mobile data services.
- Compatibility: Our eSIMs may not be compatible with all devices. It is your responsibility to ensure that your device supports eSIM technology and the relevant network bands.
4. Ordering and Account Creation
- Placing an Order: You may purchase an eSIM or data plan through our Website or other authorised channels. All orders are subject to acceptance by us.
- Account Registration: You may be required to create an account, providing accurate and up-to-date personal information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- No Resale: eSIMs purchased under these consumer Terms are for
Personal Use only and may not be resold, transferred, or distributed
to third parties. Commercial distribution requires a separate Reseller Agreement.
- Order Limits: A maximum of 20 eSIMs per order may be
purchased under one consumer account.
- Account Limits: No more than 30 active eSIMs may be held
simultaneously on any single SimplySIM user account.
5. Pricing, Payment, and Taxes
- Prices: All prices are listed in [GBP or applicable currency], inclusive or exclusive of taxes depending on your location. We reserve the right to change our prices at any time.
- Promotional Pricing: From time to time, SimplySIM may offer promotional pricing on select products or services. These promotional prices are valid only for the specified period and are subject to change any any point. We reserve the right to modify or cancel promotional offers at our discretion.
- Payment Methods: We accept credit cards, debit cards, and other payment methods as indicated on our Website. By submitting payment information, you authorise us to charge you for the total order amount.
- VAT and Other Taxes:
- UK & EU: If applicable, VAT will be charged according to the place of supply rules. For EU customers (B2C), local VAT rates may apply under relevant regulations.
- Rest of World: Orders shipped or provided outside of the UK/EU may be subject to import duties, taxes, or fees levied by the destination country. You are responsible for these charges, if applicable.
- Payment Processing: All transactions are securely processed through Stripe, ensuring encryption and fraud prevention.
- Currency and Fees: Prices may be displayed in GBP or your local currency. Additional fees may apply depending on your card issuer or bank.
6. Delivery and Activation
- Delivery: eSIM activation details are typically delivered electronically (via email or our Website).
- Activation: Instructions on how to activate the eSIM will be provided. You are responsible for following the activation steps correctly. We are not liable for any issues arising from incorrect activation.
- Commencement of Service: Service begins once the eSIM is successfully activated and used on a compatible device.
- Activation Timing: Your eSIM plan activates upon first connection to a supported network in the destination country, not at the time of purchase.
- Validity Period: The plan's validity (e.g., 7, 14, or 30 days) commences from the activation time and continues uninterrupted for the specified duration.
7. Fair Usage Policy
- Unlimited Plans: If an unlimited data plan is offered, it may be subject to a Fair Usage Policy to prevent misuse. We reserve the right to restrict speeds, suspend, or terminate service if usage is deemed excessive or fraudulent.
- Monitoring: We may monitor data usage to ensure compliance with this policy.
- Speed Caps: Unlimited data plans are subject to a fair usage policy where full-speed data is capped at 1GB per day.
- Reduced Speeds: After reaching the daily cap, data speeds may be reduced to 256KB/s for the remainder of the 24-hour period.
8. Cancellations, Refunds, and Returns
- Right to Cancel: You may have a statutory right to cancel under applicable consumer protection laws. Please see our Refund Policy for details on how to cancel or request a refund.
- No Refunds After Activation: Once the eSIM is activated, refunds may not be available unless otherwise stated in our Refund Policy or required by law.
- Defective Products: If you receive a defective eSIM or experience an activation issue attributable to our service, contact us promptly. We will work with you to resolve the issue or offer a replacement, if necessary.
- No Refunds for Unused Data: SimplySIM eSIM data plans are sold on a pre-paid basis. Once a plan is activated, any unused data at the end of the validity period will not be refunded or carried over.
- Plan Validity: Each data plan has a specified validity period, commencing upon activation. It is the customer's responsibility to utilize the data within this timeframe.
- Exceptions: Refunds for unused data may only be considered if a technical issue, attributable to SimplySIM, prevented the use of the service. In such cases, please contact our support team for assistance.
- Refund Eligibility: Refunds are considered only under the following conditions:
- The eSIM has not been activated.
- A technical issue, attributable to SimplySIM, prevents the use of the service.
Refund requests must be submitted within 30 days of purchase. Each request is subject to review and approval at SimplySIM's discretion.
- Non-Rollover of Data: All SimplySIM data plans are subject to a fixed validity period. Unused data does not carry over beyond this period unless explicitly stated in the specific plan details.
- Top-Up Considerations: When topping up, the added data inherits the remaining validity period of the original plan. It does not extend or reset the validity duration.
9. Coverage and Network Limitations
- No Guarantee: We do not guarantee uninterrupted or error-free service. Coverage, data speeds, and quality depend on network operators in each region.
- Roaming Restrictions: Certain data plans may not support roaming in all countries. Check your specific plan details for restrictions.
10. Device Compatibility and User Responsibilities
- User Responsibility: You are responsible for ensuring that your device is compatible with our eSIM and the local network in the region you intend to use it.
- Software Updates: You may be required to keep your device’s operating system up to date to maintain compatibility.
- Misuse: You agree not to use the Services for any unlawful, abusive, or fraudulent activities.
11. Intellectual Property
- Ownership: All content on our Website, including text, graphics, logos, and software, is owned by or licensed to SimplySim.
- Limited Licence: You may access and use our content for personal, non-commercial purposes. Any other use requires our express written consent.
12. Privacy and Data Protection
- Personal Data: We process personal data in accordance with our Privacy Policy and applicable data protection laws (including UK GDPR or equivalent).
- Security: We employ reasonable security measures to protect your data. However, no system is completely secure, and we cannot guarantee absolute security.
13. Limitation of Liability
- Exclusion of Certain Damages: To the maximum extent permitted by law, SimplySim, its directors, employees, or agents shall not be liable for any indirect, consequential, incidental, or punitive damages, including loss of profits or data, arising from or related to the use of our Services.
- Total Liability: In any event, our total liability for direct damages shall be limited to the total amount paid by you for the relevant Services.
- No Warranties: We provide the Services “as is” and “as available” without any warranty of any kind, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
14. Indemnification
You agree to indemnify, defend, and hold harmless SimplySim and its affiliates from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms or misuse of the Services.
15. Governing Law and Jurisdiction
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales.
- Jurisdiction: Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Changes to Terms
We may update these Terms from time to time to reflect changes in our Services, business practices, or legal obligations. When we do, we will post the revised Terms on our Website and update the “Last Updated” date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
17. Termination
We reserve the right to terminate or suspend your access to the Services immediately, without prior notice or liability, if you breach any provision of these Terms or engage in fraudulent or illegal activities. Upon termination, your right to use the Services will cease immediately.
18. Force Majeure
SimplySim shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by events beyond our reasonable control, including acts of God, war, strikes, or other similar circumstances.
19. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on our Website, constitute the entire agreement between you and SimplySim regarding our Services and supersede all prior or contemporaneous agreements, representations, or understandings.
20. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect.
21. No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
22. Affiliate and Influencer Program
- Eligibility: Participants must be at least 18 years old and have a valid SimplySIM account.
- Commission: Affiliates earn a 5% commission on the first order placed by a referred customer. Subsequent purchases by the same customer will not generate additional commissions.
- Affiliate Codes: Each affiliate is assigned a unique code, which must not be altered or shared improperly. Affiliates are responsible for maintaining the confidentiality of their codes.
- Program Changes: SimplySIM reserves the right to modify, suspend, or terminate the Affiliate and Influencer Programs at any time with 30 days' notice.
23. Promotional Codes
- Usage: Promotional codes can be applied at checkout for discounts on eligible products.
- Limitations: Codes are subject to expiration dates, usage limits, and may not be combined with other offers unless specified.
- Modifications: SimplySIM reserves the right to modify or cancel promotional codes at any time without prior notice.
24. Network Outages
- Third-Party Networks: SimplySIM utilizes third-party network providers to deliver services and is not responsible for any outages or disruptions caused by these providers.
- Support: In the event of a network issue, customers are encouraged to contact SimplySIM's support team for assistance and information.
25. Device Compatibility
- Compatibility Responsibility: It is your responsibility to ensure your device supports eSIM functionality and is compatible with our services. Refer to our Device Compatibility Checker for guidance.
- Non-Transferability: eSIM profiles are tied to the device they are installed on and cannot be transferred to another device once activated.
26. Marketing Communications
- Consent: By providing your contact information, you consent to receive service updates and promotional communications from SimplySIM.
- Opt-Out: You may opt out of marketing communications at any time by following the unsubscribe link in our emails or contacting our support team.
27. Environmental Commitment
- Carbon Offset: SimplySIM contributes 0.5% of each purchase to carbon removal initiatives through Stripe Climate.
28. Modern Slavery and Human Trafficking
- Commitment: SimplySIM is committed to preventing modern slavery and human trafficking in our operations and supply chains, in accordance with the UK Modern Slavery Act 2015.
29. Trial eSIMs
- Availability: SimplySIM offers trial eSIMs providing 100MB of data valid for 7 days, allowing users to experience our service before committing to a full plan.
- Eligibility: Trial eSIMs are limited to one per customer. Multiple requests or attempts to obtain additional trial eSIMs may result in cancellation of all associated orders.
- Verification: To prevent misuse, a nominal charge of £0.50 is applied during the trial eSIM checkout process. This charge is refunded upon successful verification of your account details.
- Refund Process: The £0.50 charge will be refunded to the original payment method within 14 days of verification. If verification fails or is not completed, the charge will not be refunded.
- Activation: Trial eSIMs must be activated within 30 days of issuance. Unactivated eSIMs will expire after this period.
- Manual Review: All trial eSIM requests undergo a manual verification process to ensure compliance with our policies and to prevent misuse.
- Fraudulent Activity: Engaging in fraudulent activities, including but not limited to creating multiple accounts to obtain additional trial eSIMs, is strictly prohibited. Such actions will result in the cancellation of all associated orders and may lead to a permanent ban from SimplySIM services.
30. Top-Up Policy
- Eligibility: Most SimplySIM eSIM plans support top-ups. However, certain plans may not be eligible for additional data. Please refer to your specific plan details to confirm top-up availability.
- Top-Up Process: Additional data can be purchased through your SimplySIM account dashboard. The added data will be available immediately after the top-up is processed.
- Validity: The validity period of the top-up data aligns with your existing eSIM plan's duration. It does not extend or reset the original validity period.
- Limitations: Top-ups are non-refundable and non-transferable. They are intended for use with the specific eSIM for which they were purchased.
31. Token Rewards Program
- Program Overview: SimplySIM offers a Token Rewards Program to incentivize customer loyalty. Tokens are earned through qualifying purchases and promotional activities.
- Earning Tokens:
- Affiliates earn tokens equivalent to 5% of the total purchase amount (excluding taxes and shipping) when a new customer uses their unique affiliate code during their first purchase.
- Additional tokens may be earned through specific promotions or activities as outlined by SimplySIM.
- Token Value and Redemption:
- Each token holds a value equivalent to £1 GBP and can be used exclusively for purchasing SimplySIM products.
- Tokens can be applied during the checkout process on the SimplySIM website. There is no minimum redemption amount; participants can use any number of tokens up to the total purchase value.
- Token Expiry and Limitations:
- Tokens expire 12 months after the date they are credited to the participant's account.
- Tokens are non-transferable and can only be used by the account holder who earned them.
- Tokens have no cash value and cannot be exchanged for cash or any other form of credit.
- Program Modifications: SimplySIM reserves the right to modify, suspend, or terminate the Token Rewards Program at any time with 30 days' notice. Any changes will be communicated through the SimplySIM website or direct communication channels.
- Fraudulent Activity: Any fraudulent activity or misuse of the Token Rewards Program, including but not limited to self-referrals, creating multiple accounts, or using automated systems to generate affiliate traffic, may result in the forfeiture of tokens and termination from the program.
32. Personal Use & Resale Restrictions
- All eSIMs supplied under these consumer Terms are intended solely for Personal Use.
Resale or redistribution without written permission is strictly prohibited.
- The caps of 20 eSIMs per order and 30 active eSIMs per user account apply to all consumer
purchases. SimplySIM reserves the right to cancel or restrict any orders that exceed these
limits.
- Businesses or organisations wishing to purchase quantities above these limits—or to distribute eSIMs to their customers—must enter into SimplySIM’s Reseller Agreement. Upon execution of a Reseller Agreement, the above consumer limits are lifted.
